Brief

Kvaerner North American Construction, Inc. (a subsidiary of Kvaerner) found itself in arbitration proceedings against an engineering and consulting firm related to the Longview Power project delivered in 2011.

What we did

HKA was retained by Dorsey & Whitney LLP.  The dispute related to claims arising out of the design and construction of the Longview Power Plant. HKA authored multiple reports and testified at arbitration proceedings addressing issues including schedule delays, liquidated damages, Force Majeure events, modularisation/pre-fabrication issues, sub-contractor change orders and other damages components.

Outcomes

Kvaerner North American Construction Inc. was awarded from the arbitration proceedings US$74 million from an engineering and consulting firm. The majority of the opinions offered by HKA were adopted by the arbitration panel.
